Selling with Uwane
Terms of Use and Seller Terms
Version 2.4 · Effective date: 7 October 2026 · Last updated: 7 October 2026
Plain-English summary (not a substitute for the full terms)
We buy bags directly. We are not a marketplace. In the US, the buyer is Corner Harajuku LLC, doing business as Corner Beverly Hills (California secondhand dealer licence 000005313). Uwane Trade is its buying service, not a separate company.
We buy only from sellers in the United States.
An online quote is a free, non-binding estimate. Nothing is agreed until we have inspected your bag and we both sign a bill of sale.
Either side can walk away at any point before signing. We may decline any bag, for any lawful reason or none.
Our team may authenticate from photos and measurements. Our team includes contracted authentication specialists, some of whom may be outside the United States and may review cleaned item photos and item details through secure messaging apps (such as WeChat). Only cleaned item photos, with embedded camera data including location removed, and item details are shared with them, never your name, contact details, ID, thumbprint or payment details. The messaging app provider may process or store those photos outside the United States.
We decide authenticity for our own purchase only. Declining a bag is not a statement that it is fake.
You promise you own the bag, it is genuine, it is free of liens and claims, and you have described it honestly. If a title or authenticity problem comes to light, we will show you the evidence, give you a chance to respond, and you may have to repay.
We follow California secondhand-dealer law: ID, a thumbprint, a report to the California Department of Justice, and a short holding period. We cooperate with the police on suspected stolen goods.
We pay by cash in person or by bank transfer (wire or ACH), only to the verified individual owner at launch. A bank transfer goes only to an account in your own name. For a purchase price above $5,000, we pay by bank transfer only. The purchase price, payment method and payment date must be agreed and written on the Bill of Sale before either party signs; a purchase cannot close with any blank. In person, we pay when the Bill of Sale is signed. For shipped Items, we pay by the date written on it, usually within 5 business days of signing.
Shipping to us: only after written, item-specific approval. You may arrange your own shipment or request a Uwane shipping kit with protective packing materials and an address-filled form or label. Follow our written instructions either way. Items above available insurance coverage are handed over in person.
Return shipping: if your bag is authentic and we simply do not agree a price, we pay. If it fails authentication or was misdescribed, you pay.
Storage: we will agree any storage charge with you in writing before it applies. We never withhold an Item for unpaid charges. Sale of unclaimed Items is not offered at launch; we will not sell, dispose of or destroy an unclaimed Item (US-8).
Market data on the site is reference only. It is never the basis of our price and it is not an appraisal.
Most disputes go to individual JAMS arbitration. You may choose a video hearing or a hearing reasonably near where you live, with small-claims and public-injunction exceptions and a 30-day right to opt out (US-12). If we start arbitration, you pay no provider filing fee. If you start, your filing fee is no more than the applicable JAMS consumer filing fee or the court filing fee, whichever is lower; we pay the rest of the provider, administrative and arbitrator fees.
Uwane Trade has no connection to Hermès.
PART A: TERMS OF USE (ALL USERS)
A1. About these Terms and who you are dealing with
The Uwane brand. "Uwane" is a brand name, and "Uwane Trade" is the name of the Uwane buying service. Neither is a separate company. Uwane Trade is run in each region by a local business (a "Regional Operator") named in the Regional Schedule for that region.
Your contract is with the Regional Operator for your region only. For the United States, that is Corner Harajuku LLC, doing business as Corner Beverly Hills (California secondhand dealer licence 000005313) (Schedule US). Uwane Trade is its buying service, not a separate company. It is the operator of record, the buyer named on every Bill of Sale, and the party that pays you. In these Terms, "we", "us" and "our" mean that Regional Operator, including anyone acting on its behalf.
Our specialists. Our specialists assess your Item for our purchasing decision. Only we buy, and a sale is complete only when both parties have signed the Bill of Sale and we have possession of the Item (B6). Until then, any Quote, Final Offer or decision is subject to B2 and B3.
No one else is party to your contract. No other person or business takes on obligations to you under these Terms. This does not affect any right you have against anyone under law. Our owners, managers, staff, contractors, agents and licensors are intended third-party beneficiaries of B10.3 (indemnity), US-10 (limits on liability) and US-12 (disputes), and each of them may enforce those clauses.
What these Terms are made of. These Terms consist of Part A (Terms of Use), Part B (Seller Terms) and the Regional Schedule for your region. If you sell an Item, the signed Bill of Sale also forms part of the contract for that sale. Our Privacy Notice is a separate notice and not part of the contract (A8).
Order of priority. The signed Bill of Sale controls the terms specific to that sale: the Item, the price, the payment method and the payment date. On every other subject, the Regional Schedule applies first, then Part B, then Part A. A Bill of Sale that says nothing on a subject does not mean these Terms do not apply to it.
Acceptance. Browsing the Site is subject to Part A. Before you submit a request or arrange shipment, we ask you to agree to these Terms by ticking a box. Before any purchase, we give you these Terms with the Bill of Sale, and you sign to confirm your agreement. A purchase happens only when both of us have signed the Bill of Sale and we have possession of the Item. If you do not agree, do not use the Site or our services.
This document covers Uwane Trade only. Uwane Trade means buying items directly from sellers. Any other Uwane service will have its own terms.
A2. Definitions
"Site" means trade.uwane.com and any other website, page, form or messaging channel that we run for Uwane Trade in your region.
"Item" means a bag, together with any accessories, packaging or documents, that you offer to us.
"Quote" means any price indication we give before inspection, including an estimate, a range, a "preliminary quote" or a figure given by message.
"Final Offer" means the price we offer after inspecting the Item.
"Bill of Sale" means the written purchase agreement that you and we sign to complete a purchase, on paper or electronically.
"Market Data" means any prices, indices, charts, auction or retail references, "sample" or "illustrative" figures, or similar information shown on the Site or sent to you.
"Business Day" is defined in your Regional Schedule.
A3. Using the Site
Who can use it. You must be at least 18 to submit anything through the Site. You may browse it from anywhere, but we deal only with sellers who meet the eligibility rules in your Regional Schedule.
Acceptable use. You agree not to:
give false information, impersonate anyone, or submit photos or information about an item you do not own or are not authorised to sell;
submit an item you know or suspect is counterfeit, stolen or otherwise unlawful, or use the Site to "test" whether a counterfeit passes our checks;
scrape, harvest, copy in bulk, or systematically download Site content or Market Data, including by automated means, or use it to build a competing product or dataset;
interfere with, probe, overload or bypass the security of the Site, including rate limits, bot checks or access controls;
upload malware or unlawful, abusive or infringing content, or content showing other people without their permission;
use the Site for any unlawful purpose, including money laundering, sanctions evasion or fraud.
Our rights. We may refuse, suspend or end anyone's access to the Site or our services at any time, for any lawful reason, without notice. We may remove any content, keep records of misuse, and report unlawful activity to the authorities.
Accessibility. We want the Site to be usable by everyone, and we aim to meet WCAG 2.1 Level AA. We are working toward that standard and do not claim that every part of the Site meets it yet. If you have difficulty using any part of the Site, email trade@uwane.com or call +1-310-388-8228, and we will help you by another means.
A4. Site content, Market Data and availability
Market Data is reference only. Market Data is general background information. It is never the basis of any Quote or Final Offer. It is not an appraisal, valuation, insurance value or tax value, and it is not a promise or prediction of any price, including what we will pay or what you could get elsewhere. It may be sampled, illustrative, delayed, incomplete or wrong. Do not rely on it for any decision.
No professional advice. Nothing on the Site is legal, tax, financial, investment or appraisal advice.
"As is." To the fullest extent the law allows, the Site and all its content are provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, merchantability, fitness for a particular purpose and non-infringement. Your Regional Schedule may preserve rights that local law does not allow us to exclude.
Availability. We do not promise that the Site will be available, uninterrupted, error-free or secure, or that a submission will be received, stored or answered. We may change, suspend or withdraw the Site or any feature at any time. If you have not received an acknowledgement, assume we have not received your request and contact us by email. We are not responsible for losses caused by downtime, lost submissions, delays, or failures of email, messaging or hosting providers.
Response times. We aim to answer enquiries as soon as we reasonably can, but we do not guarantee any response time.
Links. Links to third-party sites are for convenience only. We do not control or endorse them.
A5. Intellectual property and brands
Our content. The Site's design, text, photographs, graphics, data compilations, software and the Uwane names and logos belong to us or our licensors and are protected by law. You may view the Site for personal, non-commercial use connected with selling to us. Any other use needs our written permission.
Feedback. If you send us suggestions, we may use them freely, without owing you anything.
Hermès: no affiliation. Uwane Trade is independent and is not affiliated with, authorised by, sponsored by or endorsed by Hermès International, Hermès of Paris, Inc., or any company in the Hermès group. Hermès, Birkin, Kelly, Constance, Picotin, Evelyne, Lindy, Herbag, Garden Party and other Hermès models, and other Hermès names, logos and designs, are trademarks of Hermès. We use them only to describe the genuine pre-owned items we buy. We do not buy from Hermès, and Hermès does not authenticate, guarantee or support any purchase we make.
Copyright complaints. If you believe content on the Site infringes your copyright, write to trade@uwane.com with the details required by 17 U.S.C. §512(c)(3).
A6. We buy for our own account; we are not a marketplace
We buy Items directly and for our own account. We do not list your Item for other buyers, act as your agent or broker, hold your money in escrow, or owe you any share of any later resale price. What we do with an Item after we buy it, including its resale price, is our own business. We do not owe you fiduciary duties.
A7. Electronic communications and signatures
Consent to electronic dealings. You agree that we may give you notices, Quotes, Final Offers, receipts, the Bill of Sale and other records electronically: by email, by text or messaging app if you chose one, or on the Site. Electronic records and electronic signatures (including click-to-accept and signing on a tablet) have the same effect as paper and ink, under the federal E-SIGN Act and the California Uniform Electronic Transactions Act.
Your right to paper and to withdraw. You may ask for a paper copy of any record we are required to give you, free of charge, by writing to trade@uwane.com. You may withdraw consent to electronic records at any time in the same way. Withdrawing does not affect anything already signed, but it may mean we cannot complete a transaction remotely. To open our records you need a device that can read email and PDF files. Keep your email address up to date with us.
Delivery. A notice sent to the email address you gave us counts as received on the Business Day after we send it, unless we receive a bounce message. Use the Reply-To address provided in your receipt, or write to trade@uwane.com. Do not send ID documents or payment credentials by ordinary email.
Beware of impersonation. We will only email you from an @uwane.com address. We never charge for a Quote, and we will never ask you to buy gift cards, send cryptocurrency, share a password, or "verify" your bank details by clicking a link. A genuine request for an agreed charge (for example, return shipping) or a repayment will name the transaction and the clause it relies on. Before paying anything, verify it by calling +1-310-388-8228. Do not use contact or payment details given only in the message itself. We will never change our own payment instructions to you by email alone.
A8. Privacy
Our Privacy Notice explains how we handle personal information. It is a separate notice and does not form part of the contract, but you confirm you have been given it. The law-enforcement reporting and record-keeping described in your Regional Schedule are legal duties. We will also provide any additional notice or obtain any consent required by another applicable law before collection.
A9. Changes to these Terms
We may change these Terms from time to time. We will post the new version on the Site with a new "Last updated" date. If a change is material, we will also give reasonable notice, for example on the Site or by email to anyone with an open request.
Changes apply going forward only. The version in effect when you submit a request governs that request. The version in effect when you sign a Bill of Sale governs that sale. A change never applies to a dispute that has already arisen, or to a claim we already know about. Changes to the dispute-resolution section are covered by US-12.9.
A10. General
Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control, such as natural disasters, fire, flood, earthquake, epidemic, war, terrorism, civil unrest, strikes, utility, internet or cloud outages, cyberattacks, carrier or bank failures, government orders, and changes in law. While such an event lasts, we may suspend appointments, inspections, shipping or payments, extending the time for them by the length of the delay. We will notify you promptly and take reasonable steps to limit the disruption. A force majeure event does not cancel our obligation to pay any amount we owe under a signed Bill of Sale, which we will pay as soon as we reasonably can, and lack of funds is never force majeure.
Severability. If any provision is found unenforceable, it will be limited only as far as necessary, and the rest of these Terms stays in force. The dispute-resolution section has its own severability rule, which takes priority.
No waiver. If we do not enforce a right, or delay doing so, we have not waived it.
Assignment. You may not transfer your rights or obligations without our written consent. We may assign ours to an affiliate, a successor Regional Operator, or a buyer of our business, provided your rights under these Terms are not reduced. An assignment does not release us from amounts already owed to you, unless you agree.
Independent parties. Nothing here creates a partnership, agency, employment or fiduciary relationship between you and us.
Survival. Terms that by their nature should continue after a sale or after your use ends will continue, including warranties, clawback, indemnity, limits on liability and dispute resolution.
Language. These Terms are written in English. If we provide a translation, the English version controls, except where local law requires otherwise.
Headings and examples. Headings are for convenience only. "Including" means "including without limitation".
Entire agreement. These Terms (with the Regional Schedule and any Bill of Sale) are the entire agreement on their subject. They replace earlier statements, including statements on the Site, in messages or verbal ones, about Quotes or the purchase process. Nothing in this clause limits liability for fraud.
PART B: SELLER TERMS
Part B applies whenever you ask for a Quote, book a visit, send us an Item or sell to us. Your Regional Schedule adds local rules and may override Part B where it says so.
B1. How selling works
Enquiry. You tell us about your Item, usually through our short form: model, condition, any damage, extras, your first name and email, and photos if you wish. We may ask follow-up questions later.
Quote. We may give you a Quote, ask for more information, or decline.
Inspection. If you wish to continue, you bring the Item to our premises by appointment, or send it only by a shipping method we have approved in writing (B11).
Final Offer. After inspection and authentication (B5), we may make a Final Offer, or decline.
Sale. If you accept, we verify your identity and complete the legally required records. The sale happens when both of us sign the Bill of Sale and we have possession of the Item (B6). We then pay you as set out in your Regional Schedule.
B2. No obligation, and our right to refuse
Asking for a Quote is free. You never have to sell.
We never have to buy. Until a Bill of Sale is signed by both sides, we may decline any Item, any seller or any transaction, at any stage, for any reason or no reason. This applies even after a Quote, a booked appointment, or receipt of the Item. Examples include doubts about authenticity, condition, provenance, documentation or identity, a change in our stock needs or market conditions, legal or compliance concerns, or behaviour toward our staff. We do not have to give reasons. We will never refuse a seller for a reason the law prohibits, such as race, religion, sex, disability or another protected characteristic.
Neither of us is liable to the other for walking away before signing, except for obligations that apply whether or not a sale happens: B8, B11, B12 and B13.
B3. Quotes are not offers
A Quote is a free, non-binding estimate. It is based only on what you told us and showed us. It is not an offer to buy, a valuation or an appraisal. It does not create a contract, an option or any obligation on either side, even if it informally says "offer", "price" or "guaranteed". If your Regional Schedule gives a Quote a validity period, that period is only how long we generally stand behind the estimate, subject to inspection.
The Final Offer may be higher, lower or the same as the Quote, or we may make no offer. Things that can change it include condition, authenticity, completeness, model details, materials, hardware, colour, stamps, odour, repairs, documentation, stock levels and market conditions.
A Final Offer made in person is open only for that visit. A Final Offer made in writing is open for the time stated in it, or 3 Business Days if no time is stated. We may withdraw any Final Offer at any time before the Bill of Sale is signed.
Any figure you give us (for example, "price in mind") is for information only and binds no one.
No purchase contract until signing. No Quote, Final Offer, message, email, call, appointment confirmation, shipping label or receipt of your Item creates a contract to buy, whoever it comes from. Only a Bill of Sale signed by both of us does. Our duties of care for an Item we have agreed to receive (US-7, US-8) apply before then.
B4. Your duty to describe the Item fully and honestly
You must tell us everything you know that affects the Item's condition, value, authenticity or lawful sale. This includes wear, stains, odours, scratches, corner wear, repairs (including by Hermès spa services or third parties), refurbishment, re-dyeing, replaced or non-original parts, alterations, missing accessories, prior authentication failures, liens, disputes, and the Item's history and origin.
Photos must be of the actual Item, recent, unedited and unfiltered. They must not be stock or borrowed images.
Price adjustment. If the Item's actual condition is worse than you described or than your photos showed, or has flaws the photos did not show, we may adjust the price or decline. For minor differences in condition or appearance, we will make our best effort to honour the Quote. Whether a difference is minor is our reasonable judgement.
B5. Inspection and authentication
Our process, our decision. We inspect and authenticate Items using our own methods and judgement. Our methods may include visual, tactile, magnified, odour and UV examination, checks of materials, stitching, stamps, hardware and documents, and comparison with reference material. See the Privacy Notice. Whether an Item is acceptable to us is decided at our sole discretion, for our purchasing purposes only.
No certificate; no statement to third parties. Our decision is not a certificate or opinion of authenticity that you or anyone else may rely on. A decision not to buy is not a finding that an Item is counterfeit, and a decision to buy does not guarantee authenticity to anyone else. We do not give written authentication opinions, reasons or reports before a sale, and we do not have to disclose our methods. If we make a claim against you after a sale, we will explain the evidence as B10.1 requires, without having to reveal our methods.
Non-destructive only. We will not open seams, remove hardware or alter the Item without your written consent. We handle Items carefully. Our liability for any damage we cause is set out in your Regional Schedule.
Photos and records. We may photograph, measure and video the Item, its marks, and its arrival, unboxing and inspection, for authentication, our records, fraud prevention and legal compliance.
Later discovery. Our acceptance of an Item at inspection does not waive your warranties in B7 or our rights in B10. Authentication is not infallible, and you are the person who knows the Item's history. Our decision whether to buy does not by itself prove a breach of warranty after a sale. B10 sets out how a post-sale claim is handled.
B6. When the sale happens, title and risk
The sale is complete when you and we have both signed the Bill of Sale and the Item is in our possession.
Ownership (title) passes to us at that moment, free of all claims. Risk of loss passes to us when the Item is in our possession, except as set out for shipping in your Regional Schedule.
Before then, the Item remains yours and at your risk, except to the extent your Regional Schedule makes us responsible for it while in our care.
B7. Your promises (seller warranties)
Each time you submit a request and again when you sign a Bill of Sale, you promise (warrant) to us that:
Ownership. At launch, you must be the individual legal owner of the Item, acting on your own behalf, with full right to sell it. Representative, estate and company sales are not available.
No liens or claims. The Item is free of any lien, security interest, pledge, consignment, lease or other right that affects your ability to sell it, including any right arising from a financing or buy-now-pay-later arrangement, which you must disclose. It is not subject to any claim or interest of any other person, including a spouse or domestic partner, a former partner, an estate, heirs, a business, a creditor or a lender.
Lawful origin. The Item was not lost, stolen, embezzled, obtained by fraud, smuggled, imported or exported in breach of any law (including wildlife and customs law), or acquired in breach of a contract. It is not the subject of any pending return, refund, chargeback, payment dispute, insurance claim or police report.
Authenticity. The Item is genuine Hermès. It has not been assembled with, repaired with or modified with any non-genuine part, except as you disclosed to us in writing before sale.
Accurate disclosure. Everything you told us and showed us about the Item's condition, history and repairs is true, complete and not misleading to your knowledge after reasonable inquiry, and you have told us where you are unsure. (Your promises in B7.1–B7.4 are not limited to your knowledge.) You have disclosed everything required by B4. The documents you provided (receipts, CITES or other permits, certificates) are genuine and relate to this Item.
Identity and eligibility. You are who you say you are, you are at least 18, and you meet your region's eligibility rules. Any ID you present is genuine, valid and your own. At launch you are acting for yourself as the individual owner, and not to conceal anyone else's interest.
Sanctions and compliance. You are not on any government sanctions list (in the US, including the OFAC Specially Designated Nationals list), and you are not owned or controlled by or acting for anyone who is. The sale is not connected with money laundering, tax evasion, or other crime or its proceeds.
Taxes and reporting. You are responsible for any tax on your sale proceeds and for your own tax reporting.
These promises survive the sale for the longest period your Regional Schedule permits.
B8. Suspected stolen, counterfeit or unlawful items
We may report. If we suspect that an Item is stolen, counterfeit, unlawfully obtained or unlawfully traded, or that a person is not who they claim, we may report it, with your details and the Item's, to law enforcement and other competent authorities, and we will do so where the law requires. We may also share relevant information with the rights holder (for example, Hermès) or with an industry stolen-property register, to the extent the law allows.
We may hold the Item. We comply with legally binding holds, orders and seizures, and with lawful requests from law enforcement to the extent the law allows. While a hold lasts, we do not have to return the Item to you. Holds follow the law of your region (US-4.5). A hold does not by itself show that you have breached these Terms.
Items we are unable to verify. We will not buy, and will not knowingly put back into circulation, an Item we are unable to verify as genuine. If we are unable to verify an Item and no authority has asked us to hold it, we will make it available for you to collect in person at our premises, by appointment, at no cost to you, or return it under US-7.4. We may decline to send it by carrier where the carrier's terms do not permit it. We will not destroy an Item without your written consent, a legal requirement or a court order. We may keep a record of it, including photographs. We will tell you only that we are unable to verify the Item and unable to proceed; nothing we say or do is a statement that the Item is counterfeit.
Protection for compliance and reports. We are not liable for complying with a law-enforcement hold (in the US, B&P §21647(k)), or for good-faith reports to law enforcement or other authorities, to the extent the law protects them. Anything we share with rights holders or registers is limited to what is relevant.
Cooperation. You agree to cooperate with any lawful investigation about an Item you offered or sold to us.
B9. Payment principles
Payment methods, timing and local limits are in your Regional Schedule. The purchase price, payment method and payment date must be agreed and written on the Bill of Sale before either party signs. A purchase cannot close with any of these blank. In every region:
Payee must match ID. At launch, we buy only from, and pay only, the verified individual owner named on the ID and Bill of Sale. Representative, estate and company sales are not available. The receiving account must be in that person's own name and match the verified identity. We do not pay other people or split payments between accounts.
Checks before and after signing. We normally complete identity, ownership, sanctions and fraud checks before the Bill of Sale is signed. After signing, we may suspend payment only where payment is legally prohibited, or on specific, reasonable grounds to believe a material B7 promise is untrue. A hold, seizure or allegation alone does not establish a breach or cancel the purchase price. We will tell you the basis and what happens next, unless legally prohibited, and review the suspension promptly. Both sides keep their legal remedies.
Bank details. We will confirm new or changed payment details through a separate, known channel (for example a call to a number already on file) before paying. We will not act on payment-detail changes sent by email alone. If you give us wrong details, or details that are later compromised on your side, we are not responsible for a payment made to the account you gave and we verified, but we will help you try to recover it.
When payment is complete. Payment is complete when funds are credited to your verified account, or when cash is handed to you against your signed receipt. A bank transfer is sent at signing for an in-person sale. Bank processing time does not discharge our obligation to complete payment.
Returned or reversed payments. A failed, returned or rejected transfer does not discharge what we owe. We will investigate and re-issue promptly once the cause is fixed.
Mistaken or excess payments. If we pay you more than the agreed price, pay you twice, or pay you by mistake, you must repay the excess within 5 Business Days of our request. We may also recover it by any lawful means.
No deductions without basis. We will not deduct fees from the agreed price unless the Bill of Sale states them. We may set off amounts you owe us under B9.6 or B10, to the extent the law allows.
B10. If something turns out to be wrong: clawback and indemnity
Refund only after an established breach. You must refund the purchase price only after a breach is established by written agreement between us or through the dispute process in US-12. This applies where a promise in B7.1–B7.4 or B7.6 was untrue when made, or a material fact required by B4 or B7.5 was misrepresented or concealed. A hold, seizure or allegation alone does not establish a breach.
Evidence and response. We will identify the alleged breach and supporting evidence in writing, with copies or an offer of copies, subject to any lawful confidentiality restriction. You have 10 Business Days to respond. On an authenticity question, you may obtain a written opinion from a qualified independent authentication provider of your choice, at your cost, within 20 Business Days. If that opinion conflicts with ours, any third authenticator must be mutually acceptable and independent of both parties and the original assessments. We pay for that assessment. Its opinion is evidence and does not remove either party's dispute rights.
Repayment and reversal. A refund becomes due only when the breach is agreed in writing or decided through the dispute process, and must be paid within 10 Business Days of that agreement or decision, unless it sets another payment date. If a repayment is later found unwarranted, we restore it with any interest the law requires. The sale stays in effect unless we agree to rescind it or a binding decision requires rescission. If rescinded, the Item is returned when the money is returned, without double recovery.
Return of the Item and no double recovery. When an established breach leads to rescission and we still lawfully hold the Item, we return it when the purchase price is returned to us. If the Item has been seized or surrendered to its rightful owner, or cannot lawfully be returned because of the established breach, the refund and any recoverable losses are determined by the written agreement or dispute decision. We credit resale proceeds, insurance, other recoveries and the value of anything returned to us so that we never recover twice for the same loss, and take reasonable steps to limit the loss.
Indemnity. You agree to reimburse us and the persons named in A1.4 for reasonable, documented losses caused by a breach, untrue B7 promise, fraud or unlawful conduct established by written agreement or through the dispute process, such as refunds to our buyers and reasonable legal and investigation costs. This does not cover losses caused by our own negligence, misconduct or breach of law, or penalties that the law does not allow to be shifted to you. For a third-party claim, we will notify you promptly and let you take part. We will not settle in a way that binds you without your consent, which you will not unreasonably withhold. Legal fees are recoverable only as the law allows.
Time limits. Our claims under this section may be brought within the period in US-10.4.
Other remedies. These rights are in addition to anything else the law gives us, including our right to report the matter to the authorities.
B11. Shipping principles
Never ship without our written approval and instructions. Items sent without approval, by an unapproved method, under-insured by you or to the wrong address travel at your risk, and we may refuse delivery of them. If we do accept an unapproved shipment, we will take reasonable care of it pending collection or return at your cost.
Packing. After our written, item-specific approval, you may arrange your own shipment or request a Uwane shipping kit with protective packing materials and a form or label pre-filled with our address. We offer a free Uwane shipping kit once you accept a purchase offer, or after we confirm serious intent in writing. You may use your own box. Ship only after written, item-specific approval and instructions. Pack securely, following our instructions whichever option you choose. Include only the agreed contents, and never cash or ID documents. Photograph the Item and the sealed package and keep the tracking number. Loss or damage caused by poor packing or an inaccurate description is your responsibility.
Arrival. We may record the opening of the package on video. If the package arrives opened, tampered with, damaged or with contents not matching your description, our arrival record is evidence of its condition, and we may report it to the carrier, the insurer and, where appropriate, the authorities.
Insurance, risk and return costs are set out in US-7.
B12. Visits, appointments and safety
By appointment only. Our premises are not open to walk-in sellers. We may ask you to confirm your appointment and to give the full names of anyone coming with you, and we may limit the number of guests.
Entry and conduct. We may refuse entry, end a visit, or ask anyone to leave at any time, including if a person is abusive, threatening, intoxicated, or carrying a weapon (where the law permits us to ban weapons), declines to follow reasonable security procedures, or appears to be under duress or acting for someone not present. Our staff's safety comes first.
Security and recording. Our premises may use video surveillance for security and fraud prevention, and signs will say so. We do not record audio of conversations without the notice or consent the law requires. You may not photograph or film our staff, security features or other customers without permission.
Bring only what is needed. Bring the Item, its accessories and documents, and your ID.
Lateness and no-shows. Please give us at least 24 hours' notice to cancel or reschedule, at appointments@uwane.com. If you are more than 20 minutes late, we may shorten or cancel the appointment. If you repeatedly miss appointments without notice or cancel at short notice, we may decline to book further appointments. We do not charge no-show fees.
Your Item during a visit. During a visit the Item stays in your sight unless you agree otherwise.
Accessibility of our premises. If you need an accessible route, assistance or an alternative arrangement, tell us when you book, at appointments@uwane.com, and we will accommodate you, which may include meeting you in an accessible location.
B13. Photos and information you submit
You keep ownership of the photos and descriptions you submit.
You grant us a non-exclusive, royalty-free, worldwide licence to use, copy, store and process your photos and descriptions only to assess and authenticate your Item, make Quotes and Final Offers, keep records, prevent fraud, train our staff internally, comply with the law and defend legal claims. The licence lasts as long as we keep them under our Privacy Notice. We will not use your photos in advertising or public listings without your separate permission.
You promise that you have the right to give us this licence and that your photos do not show other people or private documents.
After we buy an Item, we own it and may take, use and publish our own photographs of it.
B14. Compliance, fraud prevention and refusal
To meet our legal duties and protect our business, we may verify any information you give us, including by checking ID documents, identity, sanctions, fraud and stolen-property databases, and by asking for proof of purchase or provenance. If you refuse, we may decline the transaction.
We will not take part in any arrangement intended to evade a legally required report, and you must not attempt one, for example splitting a sale into smaller parts, using a third party to collect proceeds, or asking us to record a different price. If we reasonably suspect such an attempt, we may refuse the transaction and report it as the law requires.
We may refuse to deal with anyone we reasonably believe has given false information, attempted fraud, threatened staff, or breached these Terms, and we may keep a record of them for that purpose, as our Privacy Notice explains.

US-2. Who can sell to us in the US
You must be at least 18, able to enter into a binding contract, and located in the United States, with the Item also located in the United States. We do not buy from anyone located outside the United States, or ship Items in from outside the United States.
Individual owner only at launch. We buy only from, and pay only, the verified individual owner acting on their own behalf. Representative, estate and company sales are not available.
You must present valid government-issued photo ID that we accept, and meet the requirements of US-4.
Spouse's or partner's belongings. If the Item is community property that your spouse or registered domestic partner uses (for example, their handbag), California Family Code §1100(c) requires their written consent to sell it. We may ask how and when you acquired the Item and who uses it, and may require that consent before we buy.
Minors. We do not knowingly accept enquiries from, or buy from, anyone under 18. If we learn that a minor has contacted us, we will stop and delete their information, except where the law requires us to keep it.
US-3. Response times and Quotes
Online enquiries are answered as soon as reasonably possible, in no particular order. We do not guarantee any response time.
A Quote is an estimate we generally stand behind for 7 days from the date we send it, subject to inspection and always subject to B2 and B3.
US-4. California secondhand dealer law: ID, thumbprint, reporting and holds
Corner Harajuku LLC, doing business as Corner Beverly Hills (California secondhand dealer licence 000005313), buys under California Business and Professions Code §21625 and following, and any applicable City of Beverly Hills requirements. Corner Harajuku LLC is responsible for every duty in this US-4. When you sell to us, you agree and acknowledge that:
ID. You must present valid, government-issued photo ID that is currently valid or was issued within the last five years, such as a US driver's licence or state ID card, a US passport, or another document the law allows. We will not buy without it. We verify ID in person.
Records. We must record and keep information including your full name, address, date of birth, physical description, ID type, number, issuing authority and expiry date, your signature, a right thumbprint (or another finger if that is not possible), your written certification that you own the Item, and a description of the Item (including stamps or serial marks) and the price paid. We take a photograph or other image of your ID only where the law requires it, and we keep and destroy any such image on the same schedule as the other ID records.
Thumbprint notice. Your thumbprint is a biometric identifier required by California law. We take it because California law requires it for this purchase. If another law that applies requires additional notice or consent, we will give that notice or ask for that consent before taking it. We do not use it to authenticate the bag or for any unrelated identification system. Only authorised personnel responsible for legal compliance can access it within our business; it is never shared with our authentication specialists. We disclose it only as the law requires or permits for the secondhand-dealer transaction. We destroy it as the law requires, including paper copies, after the applicable retention period and any legal hold have ended.
Reporting. We collect the records and thumbprint required by California law and submit the transaction information required by the California Pawn and Secondhand Dealer System (CAPSS) to the California Department of Justice. Local law enforcement may access these reports.
Holding period. We hold purchased Items for the period California law requires before selling or altering them. Law enforcement may inspect the Item during the applicable holding period. The holding period does not delay your payment.
Police holds and seizures. Under B&P §21647, a peace officer with probable cause to believe that an Item in our possession is lost, stolen or embezzled may place a written hold on it for up to 90 days, renewable as an investigation or proceeding requires. The officer may take the Item as evidence, or leave it with us as custodian. We cannot refuse a hold, and while it lasts we cannot release or dispose of the Item without written authorisation from the agency. We will tell you if a hold is placed, unless the law or the agency prohibits it.
If a hold or seizure happens before we have paid you, it does not by itself establish a breach or cancel the purchase price. We may suspend payment only where payment is legally prohibited or the specific, reasonable grounds in B9.2 apply. We will explain the basis and review it promptly, unless legally prohibited. Any claim of breach follows B10; a hold alone does not cancel the sale.
If it happens after we have paid you, we must comply. If it arises because a B7 promise was untrue, B10 applies. If the Item is released to us and no promise was untrue, the purchase stands.
Items released to someone other than us go to the person entitled to them under the applicable release procedure.
Reasonable inquiry. Dealers are expected to make reasonable inquiry where circumstances suggest that property may be stolen (Penal Code §496). We may ask about provenance and request documents for this reason. Declining to answer may mean we decline the purchase.
Retention. We keep these records for at least the period the law requires, currently three years from the CAPSS report for identification records (B&P §21628(e)). Some records are kept longer for tax and legal reasons (see the Privacy Notice).
US-5. Exotic leathers
Do not bring or ship an exotic-skin Item until we approve it in writing. Approval requires us to identify the species and review the Item's provenance and documents (for example, the CITES document, the original receipt or the Hermès certificate). We buy only where acquisition, possession, intended resale and any shipment are lawful under state and federal law. We may decline any exotic Item at our discretion.
Our policy. California Penal Code §653o restricts trade in products made from many species. On current law we do not buy lizard, python, cobra, sea turtle, elephant, or any other species restricted under Penal Code §653o, except crocodilian species that may lawfully be traded in California under current federal law and court rulings, that are traded lawfully under the Endangered Species Act, CITES and the Lacey Act, and that come with the documentation we require. We do not buy items made from any species listed as endangered under the Endangered Species Act. We review this policy whenever the law changes.
You warrant that any exotic Item was lawfully acquired, imported and traded under CITES, the Endangered Species Act, the Lacey Act and state law, and that any documents you provide are genuine and relate to the Item.
If we are legally unable to buy or return an exotic Item, we will promptly explain the issue and work towards a lawful return or other lawful resolution, including collection in person. We will not destroy or permanently keep your Item without your written agreement or legal authority.
Onward movement. We may resell or move exotic Items outside the United States only where that is lawful, which may require export documents and compliance with US wildlife law. We may therefore require the Item's full chain-of-custody documents before buying it, and documents you provide may be submitted to the authorities in support of an export application.
US-6. Payment in the US
Methods. We pay in US dollars by bank transfer (wire or ACH) or cash at our Beverly Hills premises. A bank transfer goes only to an account in your own name that matches your verified identity (B9.1); we do not pay an account held by anyone else, including a spouse, friend, other person or company. For a purchase price above $5,000, we pay by bank transfer only. The purchase price, payment method and payment date are agreed and written on the Bill of Sale before either party signs. A purchase cannot close with any blank. After signing, a change to the agreed method requires your agreement unless the law prohibits that method.
Timing. In person, we pay when the Bill of Sale is signed: cash is paid then, or the bank transfer is sent at signing. For shipped Items, we pay by the date written on the Bill of Sale, usually within 5 business days of signing. Banks may take longer to credit funds; this does not discharge our obligation to complete payment. Payment may be suspended only as B9.2 allows. A failed or returned transfer does not discharge the price.
Cash. Cash is available only where the purchase price is $5,000 or less. If cash is agreed, we pay the full agreed price at signing unless a legal restriction applies. Cash is paid only in person at our premises, to the verified individual owner, against a signed receipt. We count the cash together before you sign the cash receipt. Please raise any discrepancy before you leave. Raising a discrepancy after leaving does not waive a claim; the signed receipt is evidence of the amount paid. Any arrangements needed for a large cash payment must be completed before signing. You are responsible for your own safety once you leave our premises with cash.
Reporting. We comply with all US currency and transaction reporting laws. Federal law prohibits structuring transactions to avoid reporting (31 U.S.C. §5324), and we will not do so (see B14.2).
No fees. We deduct no fees unless the Bill of Sale says so. Your own bank's charges are yours.
US-7. Shipping, insurance and risk in the US
Your shipping choice, after written approval. Do not ship until Uwane Trade sends written, item-specific approval and instructions. After approval, you may arrange your own shipment to us or request a Uwane shipping kit with protective packing materials and a form or label pre-filled with our address. We offer a free Uwane shipping kit once you accept a purchase offer, or after we confirm serious intent in writing. You may use your own box. Ship only after written, item-specific approval and instructions. Either option must follow the approved, insured, signature-required method and packing instructions. Our written instructions confirm the carrier, account and who pays the shipping costs before anything is sent. Shipping does not complete the sale or replace identity verification. We explain the required identification and thumbprint procedure before approving shipment.
Insurance. The Item is insured for the value we agree in writing (the "Declared Value") through the carrier and account named in the written instructions. Items above available coverage are handed over in person. Before shipment, we confirm the agreed value, available coverage and any material exclusions in writing.
Risk in transit to us. For either approved shipping option, packed as instructed, we are responsible for loss or damage in transit up to the Declared Value. Your recovery does not depend on what we recover from the carrier or insurer, unless a reduced or refused claim is caused by your packing, an inaccurate description, or contents not matching your description. Do not ship if the agreed value exceeds available coverage; arrange an in-person handover instead.
Return shipping.
If the Item passes authentication but we do not agree a price (we decline it, or you decline our Final Offer), we pay the standard insured return shipping.
You pay the cost of returning the Item if it fails authentication, or if the decline is because of a misdescription, an undisclosed issue, a failed ID or legal check, or a breach of these Terms. You can choose to pay our standard insured shipping cost, to send us your own prepaid, insured, signature-required label, or to collect it in person at our premises, by appointment, at no cost. We will not keep your Item because a cost is unpaid. If you choose none of these within 30 days of our written request, US-8.3 and US-8.4 apply.
Returns go by signature-required shipping to the US address we have on file for you, which must match your ID unless we agree otherwise. We bear the risk on a return we ship until it is delivered to that address. Risk passes to you on delivery, or when you or your carrier collects the Item.
Items we cannot return. B8 applies to Items held by law enforcement, and US-5.4 to exotic Items we cannot lawfully ship.
US-8. Items in our care; unclaimed Items
Care. While an Item you still own is in our care, we will store it securely and take reasonable care of it.
Our liability for loss or damage in our care is limited to the lower of (a) the Declared Value we agree with you in writing before we take the Item into our care, whether it arrives by approved shipping or is left with us after a visit, and (b) the cost of repair or the actual loss in value. If no Declared Value was agreed, the limit is the Item's fair market value immediately before the loss (see also California Civil Code §1840). You may also keep your own insurance. This limit does not apply to our gross negligence or wilful misconduct (US-10.3).
Storage charges agreed in advance. We will agree any storage charge, including its rate or method of calculation, with you in writing before it applies.
Notice period. No storage charge applies during the first 30 days after our written request to collect the Item or give return instructions.
No charge where you cannot collect. We do not charge storage during an authority hold preventing release or during a delay caused by us.
Never withheld. We never refuse to return or release your Item because any charge is unpaid. Any agreed unpaid charge may be recovered only by lawful means.
Unclaimed Items. An Item is not forfeited just because time has passed. Sale of unclaimed Items is not offered at launch. We will not sell, dispose of or destroy an unclaimed Item. We keep storing it and it stays available to you, subject to lawful authority holds. We may ask a court for directions.
US-9. Taxes
We don't collect sales tax from you when we buy your bag. You're responsible for any tax on your proceeds. We ask for tax forms only where they apply to the transaction, and we don't promise that a sale is tax-free. We do not give tax advice.
US-10. Limits on our liability
Cap. To the fullest extent California law allows, our total liability to you for any claim related to a Quote, enquiry, visit, inspection, shipment, Item in our care, or purchase is limited to the agreed purchase price of the Item concerned, or if there is no purchase, its Declared Value, or if none was agreed, its fair market value at the relevant time. Our total liability for any claim about the Site alone (not about an Item or your personal information) is limited to $100. These caps never reduce a purchase price we owe you, and they do not apply to personal injury.
Excluded losses. We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profit, bargain, resale opportunity, or sentimental value, including any difference between our price and any price you might have obtained elsewhere, and any reliance on Market Data.
What we do not limit. Nothing in these Terms limits or excludes liability for our own fraud, wilful injury to person or property, gross negligence, or violation of law, or any liability that California law (including Civil Code §1668) does not allow to be limited. Nothing in these Terms waives any right you have that cannot be waived by contract.
Time to bring claims. Each side may bring claims within the limitation period that applies by law, including its rules on when time starts to run and on pausing it.
US-11. Governing law
These Terms and any dispute about them, the Site or any transaction are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules. The arbitration agreement in US-12 is governed by the Federal Arbitration Act.
US-12. Disputes: informal resolution, arbitration and class-action waiver
Please read this carefully. It affects your legal rights, including your right to go to court and to bring or join a class action. You may opt out within 30 days (US-12.8).
Talk to us first. Before starting any claim, the person bringing it must send a written notice. Send yours to trade@uwane.com or by mail to the US-1 address. We will send ours to your email on file. The notice must include your name and contact details, a description of the dispute, and the relief sought. Both sides will try in good faith to resolve it for 45 days, including by a call if either side asks. Time limits for bringing claims are paused from receipt of the notice until this period ends. Urgent court relief under US-12.6(a) need not wait.
Binding individual arbitration. Any dispute, claim or controversy between you and us that is not resolved informally will be decided only by binding individual arbitration. This covers disputes arising out of or relating to these Terms, the Site, any Quote, visit, inspection, shipment or purchase, or our relationship. Other disputes about the scope or enforceability of this arbitration agreement are for the arbitrator, to the extent the law allows. A court decides whether an agreement to arbitrate was formed at all, and any dispute about US-12.6(b) or US-12.7. The matters reserved to courts in US-12.5 and US-12.6 are also excepted.
Rules and provider. Arbitration will be administered by JAMS under its applicable rules, including the JAMS Consumer Arbitration Minimum Standards, as modified here. The provider's consumer protections and the fee terms in US-12.4 apply as a matter of contract, whatever rules the provider applies and however it classifies the case. If JAMS decides its consumer standards do not apply, its Comprehensive Arbitration Rules and Procedures govern procedure only. A single neutral arbitrator will hear the case. You may choose a video hearing, or a hearing in Los Angeles County or at a reasonably convenient location in the county where you live. Claims under $25,000 may be decided on documents alone if you choose. The arbitrator may award any individual relief a court could award, including public injunctive relief only as US-12.6 allows, and must give a written reasoned decision.
Fees. If you start arbitration, your filing fee is no more than the applicable JAMS consumer filing fee or the filing fee for the same case in California superior court, whichever is lower, subject to available hardship relief. If we start arbitration, you pay no provider filing fee. We pay all remaining provider, administrative and arbitrator fees, however the case is classified. We will pay them promptly, and in any event within the timeframes of California Code of Civil Procedure §§1281.97–1281.98, whether or not those sections apply. Nothing here limits nonwaivable rights or remedies concerning fee payment. Each side pays its own lawyers unless fees are awarded under a law that allows them or for a frivolous or bad-faith claim or defence.
Small claims. Either side may instead bring an individual claim in small claims court in Los Angeles County, or in the county where you live, if the claim qualifies and stays there.
Other carve-outs. Either side may go to court for:
(a) provisional remedies in aid of arbitration (Code Civ. Proc. §1281.8); and
(b) public injunctive relief, which cannot be waived under California law. No class-action waiver or stay provision in these Terms limits such a claim. Whether to stay it is for the court to decide.
Class-action and representative-action waiver. To the fullest extent the law allows, you and we may bring claims only individually, not as a plaintiff or class member in a class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or award class-wide relief. If this waiver is unenforceable as to a particular claim or remedy, that claim or remedy will be decided in court and will not be sent to class arbitration. No class-action waiver or stay provision limits a claim for public injunctive relief under US-12.6(b); whether to stay that claim is for the court to decide.
30-day right to opt out. You may opt out of this arbitration agreement by emailing trade@uwane.com with the subject line "Arbitration Opt-Out", or by writing to the US-1 address. Include your name and email. You may do so within 30 days after you first tick to agree to these Terms, and again within 30 days after you sign any Bill of Sale. An earlier opt-out stays in effect, and a later Bill of Sale does not cancel it. Opting out does not affect any other part of these Terms, any Quote or Final Offer, or how we treat you. If you opt out, US-12.10 applies.
Changes. If we make a material change to this US-12, the change applies only to disputes that arise after it takes effect. You may reject it by writing to us within 30 days of the change, and the earlier version will continue to apply to you.
Court venue if arbitration does not apply. If you opt out, or a claim is not subject to arbitration, it must be brought only in the state or federal courts located in Los Angeles County, California, and both sides submit to their jurisdiction. Small claims remain available under US-12.5.
Severability of this section. If any part of US-12 (other than US-12.7) is unenforceable, the rest still applies. If US-12.7 is unenforceable in its entirety, US-12 (other than US-12.1 and US-12.10) is void, and US-12.10 applies.
Related demands follow the provider's own mass-arbitration rules, if any. There is no additional batching, queueing or bellwether procedure.
US-13. California notices
